What personal information do we collect?
We may collect personal information including (but not limited to) your name, address, telephone number, email address, date of birth, identification documents, financial information, employment details, rental history, sales history, and any other information reasonably necessary for us to provide our real estate and/or strata agency services.
How we collect personal information from you
We will collect personal information from you in the following circumstances:
Property Management
- if you are a prospective or current landlord and you want us to manage your property;
- if you are a prospective or current tenant and/or you inspect any rental property; and
- if you are a prospective or current tenant and you apply to rent a property, including throughoutthe tenancy.
Sales
• if you are a prospective or current vendor and you want us to act as your sales agent; • if you are a prospective or current purchaser and you inspect any property; and • when you make enquiries in relation to a property.
Strata Management
- if you are a prospective or current owner in a strata scheme that we manage or propose tomanage; and
- when you make enquiries relating to strata management services.
How we collect personal information from other sources
We may collect personal information from other sources where it is reasonably necessary for us to do so, including from agents, landlords, tenants, referees, insurers, valuers, contractors, legal and financial advisers, public registers, and publicly available sources, in any manner permitted by the Act.
When the law authorises or requires collection of personal information
There are laws that may require us to collect and disclose your personal information, including the Property, Stock and Business Agents Act 2002 (NSW) and associated regulations.
How your personal information may be used
We may collect, use and disclose your personal information for purposes including (but not limited to):
- providing property management, sales and strata services;
- verifying identity;
- processing applications and transactions;
- advertising and marketing properties;
- communicating with landlords, tenants, buyers and sellers;
- complying with legal obligations;
- operating trust and controlled money accounts; and• direct marketing of our services, unless you tell us not to.
How we share your personal information
We may disclose your personal information to third parties such as landlords, tenants, buyers, sellers, solicitors, settlement agents, accountants, financiers, valuers, insurers, contractors, government authorities, IT service providers and other service providers where reasonably necessary to provide our services or as required by law.
Sharing personal information outside Australia
We may store personal information using cloud or electronic storage systems that may be accessed from outside Australia. We will take reasonable steps to ensure that any overseas recipient complies with the Act.
If you do not provide personal information
If you do not provide personal information to us, we may not be able to provide you with the services you request, including processing rental applications, managing a tenancy, selling or purchasing property, or providing strata management services.
Anonymity and pseudonymity
We are not always able to deal with individuals who do not identify themselves, particularly where we are acting for a vendor or landlord, or where identification is required for inspections, applications or transactions.
Information security
We take reasonable steps to protect personal information we hold from misuse, loss, unauthorised access, modification or disclosure.
Accessing your personal information
You may request access to, or correction of, personal information we hold about you by contacting our Privacy Officer. We may charge a reasonable fee for providing access where permitted by law.
Complaints
If you have a complaint regarding our handling of personal information, please contact us. We will investigate and respond within a reasonable time. You may also lodge a complaint with the Office of the Australian Information Commissioner.
